The mother turns against all those involved, denouncing that "those responsible for providing safe hygiene conditions and adequate medical care failed in the case of this girl and led to a painful death".

Law firm Arnold & Porter representing the family of the baby, said that 10 days after their arrival in Dilley Mary lost two pounds (almost 1 kg) is nearly 8% of its weight. According lawyers, two days before their mother was released from the center, the young girl was still coughing, in addition, vomiting.

Shortly after the two were released, the child was hospitalized for respiratory failure and died at a Pennsylvania hospital in May.

"We work with Yasmin and her family to get justice due to errors by the ICE, as well as to ensure that no other family has not suffered from such unnecessary and devastating loss, "says the firm".

Under Arizona state law, the City of Eloy has 60 days to respond to Juarez's claim before further legal action can be taken, the claim states.

That same day, the Texas Department of Family and Protective Services said it received the name of the child and other pertinent information and immediately opened an investigation, according to DFPS media relations manager Patrick Crimmins.


Juarez's lawyers said Mariee was healthy, when she first arrived at the Dilley facility, but that her condition deteriorated.

"Comprehensive medical care is provided to all individuals in ICE custody. Pursuant to our commitment to the welfare of those in the agency's custody, ICE spends more than $250M annually on the spectrum of healthcare services provided to those in our care", the statement continued.

Juarez sought medical treatment for her daughter on March 11 - six days after they arrived at the Dilley facility - according to her attorneys. The toddler was prescribed Tylenol after a diagnosis of acute upper respiratory infection. Before leaving, a "licensed vocational nurse" cleared Mariee to leave.

"What started with a cough and congestion and runny nose, turned into intermittent fevers... sometimes spiking as high as over 104 degrees", Jones said.

Mariee spent the final six weeks of her life in a hospital being treated for a respiratory infection.

They allege that the conditions at Dilley were "unsafe and unsanitary conditions" and that the medical care was "deficient in both availability and quality".
