Uber ends mandatory arbitration for sexual assault cases

Uber, acknowledging that "sexual violence remains a huge problem globally", will no longer require sexual assault and harassment victims to go through arbitration, the ride-hailing company said Tuesday.

Critics have been pressuring the company to change the practice, the Times said.

"So moving forward, survivors will be free to choose to resolve their individual claims in the venue they prefer: in a mediation where they can choose confidentiality; in arbitration, where they can choose to maintain their privacy while pursuing their case; or in open court", West wrote. "I want to thank (CNN) for the reporting that you've done on this issue".

Despite repeated requests, the company has yet to agree to an on-camera interview with CNN.

A day after Fowler's report went public, Uber hired Eric Holder, a former U.S. attorney general under president Barack Obama, to investigate allegations of sexual harassment.

Uber has also made two other promises in its announcement. As with the arbitration change, this will apply to cases now pending and cases moving forward. Along with the ending of forced arbitration agreements, Uber also says that it plans to release a report about the sexual harassment and assault incidents that occur during use of its services, yet no date for that report has been announced.

Chammout was among a group of drivers who were grandfathered into Uber's system.

"Divulging the details of what happened in a sexual assault or harassment should be up to the survivor, not us", West said.

In March this year, Uber came under fire after records revealed that the company had tried to force the women to resort to individual arbitration. CNN's analysis came from an in-depth review of police reports, federal court records and county court databases for 20 major United States cities.

The legal overhaul puts Uber, which a year ago was regarded as one of the most toxic workplaces in Silicon Valley, at the forefront of a movement to change how sexual harassment is handled in corporate America. "Once people know we're counting and we're paying attention then what is a vastly unreported crime today will become more reported - and that's a good thing". Hearings have the trappings of a court hearing-arbitrators are often retired judges-except that they are wholly private.

Police say after dropping off a female passenger at her West Oak Cliff home, Chammout followed the woman inside, hit her over the head and sexually assaulted her.

Uber's arbitration policy had previously been challenged in lawsuits, according to CNN.
