TN law minister C. V. Shanmugam told reporters outside the Supreme Court complex in Delhi that the state is happy that a situation has now been created-due to the consistent efforts of the Amma government for several years-for the farmers of TN to get their due share of Cauvery water. He also said that it's time for the Centre to set up Cauvery management board as per the earlier apex court order. The states concerned, namely Tamil Nadu, Karnataka, Kerala and Puducherry, were given copies of the draft scheme and asked to respond by Wednesday.

On Monday, attorney-general K.K. Venugopal said the Centre "had not given any name to the scheme, which could be a board, authority or a committee and it would be up to the court to suggest the name". The nomenclature could be left to the riparian States to debate or, if the Supreme Court wishes, the Union Cabinet could clear the draft under Section 6A of the Inter State River Disputes Act.

Giving its ruling on appeals against the CWDT's final award, the Supreme Court on February 16 directed the Centre to constitute the CMB within six weeks.


"If any delay or shortfall is caused in release of water on account of default of any state, the authority shall take appropriate action to make good the deficiency by subsequently deducting indented releases of that state". Out of the 419 tmcft allocated to Tamil Nadu, 192 tmcft would be supplied by Karnataka.

The judgment was passed on a batch of appeals by Karnataka, Tamil Nadu and Kerala, challenging the 2007 award passed by the Cauvery River Water Disputes Tribunal which determined the utilizable quantum of water in the Cauvery at 740 tmcft.

Palaniswamy's deputy O Panneerselvam said former chief ministers MG Ramachandran and J Jayalalithaa had struggled to secure Tamil Nadu's interests on the complex issue. But the order was not obeyed, leading to Tamil Nadu government preferring a contempt petition against the Union government.
