In opening statements in a California federal damages trial, an eight-member jury was told by Apple lawyers that Samsung owes it more than $1 billion. The case was decided in Apple's favor in 2012 and it was awarded $1.05 billion in damages.

As Samsung had made a total of $1 billion in profit and $3.3 billion in revenue by selling millions of smartphones, it's fair that Apple's three design patents receive $1 Billion as a damage recovery sum amount.

It's been going on for years, the ongoing battle between Samsung and Apple is back in a US Court and the two component buddies, are at each other's throat. Samsung argues the Cupertino-based technology company should only get a portion of the profits that directly relate to the three design patents at issue. Apple has disputed that while it's a much of money, "Samsung violated millions and millions and millions of times". The jury now has to decide whether the South Korean company should have to pay damages on the entire iPhone or just the components it infringed on. "This is the article of manufacture", Quinn said of the components.


After the latest retrial, Samsung, Apple and Intel are scheduled to stand together in the United States trade watchdog FTC's suit against Qualcomm for the latter's alleged attempt to charge its customers for patented technology that it did not actually use. The scope of Apple's design patents "are so very narrow" he said. The first jury had awarded damages based on those patents and on trade dress for 13 Samsung models, necessitating a recalculation of damages for the utility patent infringement only. "They're seeking profits on the entire phone", explained Samsung lawyer John Quinn.

Then, a retrial in 2013 won Apple $290m - this case was then appealed to the Supreme Court, where Samsung attempted to rubbish the original ruling's basis that damages from a single design patent could influence a product's profits. The glass is easily separated from the phone and doesn't cost much, Samsung has argued.

Apple has described how the iPhone and overall product design became embedded in the company's DNA. However, Apple may still be able to convince the jury that the devices would not have been marketable without the infringing designs and therefore the phones as a whole should be considered the relevant article. But she's blocked Apple's argument that the phones should be viewed from the perspective of a "designer of ordinary skill in the art", saying there's no basis for importing the "person of ordinary skill in the art" to the design context.
